Terms of Service

Article 1 — Scope

These Terms of Service ("Terms") govern any order placed on hospitalityaistudio.com with NCS Services Ltd, a company incorporated in Mauritius (BRN C-18161201), registered office: Le Parc de Mont Choisy, Mont Choisy, Mauritius (the "Provider").

Placing an order constitutes full and unreserved acceptance of these Terms by the customer ("the Customer"). The applicable Terms are those in force at the date of the order.

Article 2 — Services

The Provider offers, in particular:

  • AI Premium Audit — a personalised operational analysis report for a hospitality establishment (restaurant, bar, hotel), generated from an online questionnaire and proprietary algorithms.
  • Additional services (Menu Intelligence, advisory) described on the dedicated pages.

Article 3 — Pricing and payment

The price of the AI Premium Audit is EUR 149 (one hundred and forty-nine euros). As NCS Services Ltd is not subject to VAT, this price is net of all taxes; any local taxes, withholding taxes or import duties applicable in the Customer's jurisdiction remain the Customer's sole responsibility.

Payment is processed online through our secure payment processor, which may convert the amount into the Customer's local currency at the rate displayed at checkout. The order is confirmed upon successful receipt of payment.

Article 4 — Delivery

The audit report is delivered by email as a PDF within 48 business hoursfollowing payment confirmation, and in any event no later than 7 calendar days.

If this 7-day maximum is exceeded due to a fault of the Provider, the Customer may request a full refund, provided the deliverable has not yet been issued.

Article 5 — Right of withdrawal and refund policy

Where the Customer qualifies as a consumer under EU law (Directive 2011/83/EU, Art. 16(m)), UK law (Consumer Contracts Regulations 2013, Reg. 37(1)(a)), or any equivalent national rule, the Customer expressly waives their statutory right of withdrawal when confirming the order, as the service consists in the supply of bespoke digital content whose performance begins immediately after payment.

Consequently:

  • Before the report is delivered: the order may be cancelled and refunded in full upon request at info@hospitalityaistudio.com.
  • After the report is delivered: no refund is due, the service having been fully performed.
  • Exception: in case of a manifest error by the Provider (non-conforming, corrupted, or mismatched deliverable), a new report is issued free of charge or the order is refunded in full, at the Customer's option.

Article 6 — Customer obligations

The Customer undertakes to provide accurate, complete and up-to-date information when filling out the audit questionnaire. The quality of the report depends directly on the quality of the data provided; no refund may be claimed on grounds of incorrect information supplied by the Customer.

Article 7 — Intellectual property

The delivered report is licensed to the Customer for internal use within their establishment. Public distribution, resale, or inclusion in a third-party commercial offering is prohibited without prior written authorization.

Article 8 — Liability

Recommendations contained in the report are advisory in nature. The Provider does not guarantee any specific business outcome and shall not be liable for decisions taken by the Customer based on the report. The Provider's liability is in any event limited to the amount actually paid for the relevant service.

Article 9 — Personal data

Personal data processing is described in our Privacy Policy.

Article 10 — Governing law and dispute resolution

These Terms are governed by the laws of Mauritius. Failing amicable resolution, any dispute falls under the jurisdiction of the courts of Port-Louis (Mauritius). Consumers residing in the European Union retain the benefit of mandatory provisions of their national law and may use the EU online dispute resolution platform: ec.europa.eu/consumers/odr.
